Good afternoon,

A hearing date is scheduled for your pending appeal. This is a friendly reminder of administrative deadlines prior to your upcoming hearing. The agenda is attached and on the Public Notice Website.

At the hearing, you will have 5 minutes for your presentation and 5 minutes for closing statements. Please keep your presentation about access to the records. Please know the Director reviewed your appeal in advance of the meeting and may ask questions.

Attendance is available over Zoom. To join via Zoom please register using the link on the agenda before the hearing. Your microphone will be muted, and your camera will be off until I add you as a panelist. The chat box will not be available.

Governmental Entities: Governmental entities shall submit a "written statement of facts, reasons, and legal authority" in support of the governmental entity’s position. Utah Code 63G-2-403(5).   Please send a copy of the written statement to the requester by first-class mail, postage prepaid. You can send the statement to the Director via email... If the appeal is regarding classification of the records, please provide the disputed records before the meeting so the Director can review those as he reviews the appeal per Utah Code 63G-2-403(9)(a)(ii). Providing the disputed records the same day as the statement of facts is idea[l].

Petitioners: Petitioners are not required to submit a "statement of facts, reasons, and legal authority", but if you wish to submit anything in addition to your appeal they must be submitted no later than five business days before the meeting, according to Administrative Rule R20-3-2(2). If your appeal is resolved and you'd like to withdraw, or if you need to postpone your appeal hearing, please let me know in writing as soon as possible pursuant to Administrative Rule R20-3-1(3). Email is fine.

For updates, please refer to the Utah Public Notice Website here.
